1 - Subject and field of application
The present sales conditions aim to define the contractual relation between Planète Air sarl - France Trampoline and the buyer, as well as the conditions applicable to any purchase completed through the commercial Planète Air sarl - France Trampoline website, whether the buyer be a professional or a consumer. The acquisition of a good or service through this site implies an unreserved acceptance by the buyer of the present sales conditions. 3 - Price
The prices of our products delivered in Metropolitan France and in Europe are listed in Euros with all taxes included except for participation in fees for packaging, posting and shipping. The prices of our products delivered in French Overseas Departments and Territories (DOM TOM) and outside Europe are indicated in Euros, exclusive of tax and exclusive of packaging, posting and shipping charges. Payment of applicable VAT as well as customs duties to fiscal authorities and local customs agencies are the responsibility of the client. Planète Air sarl - France Trampoline reserves the right to modify its prices at any time, with the understanding that the price listed on the internet site on the day of the order will be the only one applicable to the buyer. Any change in the VAT rate can be reflected in the price of the products and services. Prices and conditions applied are those in effect on the day the order was received. In this framework, indications of product availability are furnished at the moment the order is confirmed. 6 - Means of payment
Payment of purchases made on the Internet site of Planète Air sarl - France Trampoline is completed at the time of the order, in a means chosen by the buyer : - By bank card belonging to the CB, VISA and MASTERCARD networks: bank card payments are made through the secured system of CREDIT AGRICOLE which uses the SSL protocol (Secure Socket Layer) in such a way that the transmitted information is encrypted by a software programme that no third party may become aware of in the course of transport over the network. For all purchases, the buyers, physical, non professional persons, may choose the method of payment by bank card in “3 no-fee installments.” This means of payment may only be made by telephone. The buyer will be debited the amount of his/her order at three deadlines on his/her bank card. The first debit will take place the day of the order and will be equal to 40% of the ATI total amount. For all purchases, the buyers, physical non professional persons, may choose the means of payment by cheque in « 3 no-fee installments.». The order will be validated after receipt of 3 cheques and after the first cheque, representing 40% of the order, has been deposited. Transfer fees are to be paid by the buyer. - By Administrative Order : this payment method is reserved to administrations : Mayor’s Division, Conservatory, School, Orchestra. The client’s order will be considered as accepted after confirmation of payment and its validation by Planète Air sarl - France Trampoline. Merchandise will remain the property of Planète Air sarl - France Trampoline until the complete payment of the invoice (Law N° 80335 date 12 May, 1980).
7 - Deliveries
GENERAL CONDITIONS : The client commits to transmit, upon placing an order, all information necessary for delivery in order to guarantee its successful conclusion. In particular, the client should submit a telephone number which the transport agent may use to contact the client during the day. The client commits for himself/herself or for the recipient of the order, to receive delivery of the merchandise at the address indicated in the order. Upon delivery, the client or the recipient of the products should be able, if asked, to offer proof of his/her identity. The client commits, after the opening and verification of the content of the parcel or parcels in the presence of the delivery agent, to sign the delivery receipts presented by the delivery agent. In the event of damages, improper delivery, problems in the packaging or defective products, refer to the article « managing returns ». Delivery does not include product installation. DELIVERY PERIOD : Time of delivery is 10 business days maximum. In case of payment by cheque or transfer, the order will only be processed upon receipt of payment. Delivery delay can in no instance result in payment of damages or interest to benefit the client or client’s service providers. In case of late shipment, an email will be sent to the client. In this case, as long as the product has not been shipped, the client has the option of asking for reimbursement in the form of credit which will be added to the client account within 48 hours. This credit is valid for 1 year counting from the date of issue. If the client chooses to be reimbursed, a cheque or a transfer of the amount of the product will be sent within 15 days following the issue of this credit. POST, PACKAGING AND SHIPPING FEES : For every trampoline order deliverable in Metropolitan France, Planète Air sarl - France Trampoline offers post and packaging free of charge (except when a special anotation is made on the estimate and on the order). For orders covering accessories only (not delivered with a trampoline), a handling fee is added to the order. This amount, fixed according to the nature and quantity of the products, is communicated before the final confirmation of the order. For any destination outside Metropolitan France, post and packaging charges are communicated before final confirmation of the order. DELIVERIES TO THE OVERSEAS DEPARTMENTS AND TERRITORIES : Orders to be delivered to an Overseas Department or Territory are billed excluding VAT. At delivery, local fiscal and customs authorities will require : 1 the amount of applicable VAT, 2 port duty (at the discretion of local authorities), 3 customs inspection fees. These costs are the responsibility of the client. POSSIBLE MEANS OF DELIVERY : - Colissimo (French Postal Service) or Exapag: orders weighing less than 25 kg and not exceeding certain bulk dimensions. Delivery of products on receipt of signature, or in the case of client absence, a notice of passage is left. This means of transport is not covered by any insurance. - Delivery of bulky products (more than 25 Kg) : in the case of bulky products – trampolines in particular -, the buyer should check, in advance, the entrance dimensions (door, elevator, stairwell passage, etc.) Deliveries are made to the threshold of the address of the recipient, if it is accessible by the delivery vehicle. The delivery agent is in no instance required to deliver merchandise to the recipient if he/she lives on an upper floor. When the delivery appointment is set for these bulky products, the firm hired for delivery may nevertheless propose a delivery requiring several individuals with a supplemental fee, charged to the client and to be paid by the firm hired to complete delivery. If the client refuses this option and decides to help the delivery agent, the agent will not carry the article up, and the agent will set the article down on the ground floor.
8 - Managing returns
1. Parcels not distributed by the service provider : in the event of non-receipt of a parcel, an investigation will be conducted with the transport agent. During this period, no reimbursement or second shipment may be made. In the case of a confirmed declaration of loss of the parcel by our transport agency, depending on the nature of the product, available stock and according to the wishes of the client, we will propose to reship the product initially ordered or an exchange product with equivalent specifications. Lack of presence on the clients behalf (delivery appointment missed, non-collection of the parcel after an attempt to deliver notice has been left, etc.) will lead to extra shipping fees chargeable to the client. In the event that the client does not wish to have the product initially ordered or an exchange product with equivalent characteristics reshipped, a credit will be issued to his/her account within 48 hours following the receipt of the parcel by Planète Air sarl - France Trampoline. This credit is valid for 1 year counting from the date of its issue. If the client chooses to be reimbursed, a cheque or a transfer of the amount of the product will be sent within the 15 days following acceptance of the return. 2. Damage due to transport: this instance concerns damaged parcels, fractured packages, missing or deteriorated products. The client must indicate detailed reservations on the delivery sheet, have the delivery agent co-sign and retain a copy of the document. If the product is damaged, the client must refuse the parcel and note reservations on the delivery receipt (parcel refused because it is opened or damaged upon delivery, precisely describe damages). These reservations should be very precise. The anotation « subject to unpacking » does not constitute a detailed reservation and has NO JURIDICAL VALUE. It is therefore indispensable to precisely describe the state of the packaging and/or the product, and to precisely characterise the damages (for example : signs of breaking, open package, damaged packaging, ripped, dented on lower right corner, product scratched, dented, on left side, parcel refused because of opening or damage at delivery, etc.). The client must also confirm by registered letter these reservations to the delivery agency at the latest within 48 operational hours following the receipt of the article(s), and transmit a copy of this letter to : Planète Air sarl - France Trampoline - SAV . 24, rue Minvielle 3300 BORDEAUX, by carefully restating the references indicated on the delivery notice. To be noted: verification of the state of the product is considered complete henceforth once the delivery notice has been signed. As a result, IN CASE OF NON-COMPLIANCE WITH THE INSTRUCTIONS ABOVE, NO CLAIMS WILL BE ACCEPTED (Article L.133-3 of the Code of Commerce). With the signature of the delivery receipt and with no detailed reservations listed, and with acceptance of the products, the client recognizes having received the merchandise in a state to give him/her complete satisfaction. Henceforth, no claim linked to the state of the products delivered can be received. After receipt and acceptance of the parcel by our services, depending on the nature of the product, stocks available and according to the wishes of the client, we will propose to resend the product initially ordered or an exchange product with equivalent characteristics. In the event that the client does not wish to have the product initially ordered resent or an exchange product with equivalent characteristics, a credit will be issued to the client account within 48 hours after the receipt of the parcel by Planète Air sarl - France Trampoline. This credit is valid for 1 year starting from the date of issuance. If the client elects to be reimbursed, a cheque or a transfer of the amount of the product will be sent within 15 days following the acceptance of the return. 3. Delivery that is not in compliance with the order in quality or in quantity : the client should address a letter or email describing in detail the state of the products received. Any request for service after sale not transmitted through the above procedure will not be sustained. A confirmation of acceptance will be sent to the client within a period of 48 to 72 hours. Once acceptance has been given and if the return is judged necessary, the return address for acceptance of the defective product and the mode of transport to be used in that event will be transmitted to the client. Post and packaging charges such as in the eventual return of the product will be reimbursed by a credit valid for 1 year starting from the date of issuance. The cost of a second shipment will also be charged to Planète Air sarl - France Trampoline. Returns in Metropolitan France are exclusively done after agreement of the after sales service by sending in return the acceptance form. Returns from outside France will be reimbursed in the form of a credit valid for 1 year. Any return of merchandise made outside of this procedure will not be reimbursed. In every case, the maximum total amount accepted by Planète Air sarl - France Trampoline can not exceed 40 euros (in the case of parcels weighing more than 30 kg). Return of products should be done in their ORIGINAL PACKAGING, in perfect condition, accompanied by all accessories and including product notices. Articles returned incomplete, broken, damaged, used or soiled can not be accepted, and will be sent back at the expense of the client. 5. Cancellation and right to return : by application of article L 121-16 of the consumer code, buyers, physical, non-professional persons, benefit from a cancellation period of seven days starting from the delivery of their order to make a return of the product to the seller for exchange or reimbursement without penalty. All the articles may be the object of exchange or reimbursement within the legal time limit. The date of shipment is valid for the calculation of this time limit. Return costs are the responsibility of the client. The client should send a letter or an email stating his/her wish to use the right of cancellation. Reimbursement of products will be made within a period of 15 days or less after receipt of the products to our care. Choice of reimbursement will be made by Planète Air sarl - France Trampoline by credit to the client bank account or by bank cheque addressed to the name and billing address of the client. No cash on delivery reimbursement will be accepted regardless of the reason.
9 - Guarantee
Planète Air sarl - France Trampoline ensures to all its clients a contractual guarantee corresponding to each product line, whose duration is mentioned on the product presentation pages as well as the rates for Trampolines, Accessories and Replacement Parts. This guarantee offered by Planète Air sarl - France Trampoline does not cover: - replacement of parts due to wear and tear, - steel corrosion, - waterproofing of cushions, - tears to fabrics or to nets, - fissures, breaks or bending of steel in case of shock, - stitching problems if pulled, - abnormal or unintended use of products. In this respect, we ask that you carefully consult the user guide included with products, - damages due to the intervention of a repair operator not approved by Planète Air sarl, - resulting from a cause external to the equipment (for example, accident, shock, lightning,, heavy winds, etc...). The implementation of the Planète Air sarl - France Trampoline guarantee is made by replacement of the damaged product. In case the product can not be replaced, Planète Air sarl - France Trampoline will proceed to its repair or replacement by a product with equivalent characteristics. The contractual guarantee does not exclude the benefits of the legal guarantee against hidden damages, that is in effect for a period of 6 months beginning on the date of delivery.
10 - Liability
Planète Air sarl - France Trampoline, in the process of online sales, is held only by an obligation of means ; its liability can not be incurred for damage resulting from utilisation of the Internet network, such as loss of data, intrusion, infection by computer virus, service interruption, or other involuntary problems. Planète Air sarl - France Trampoline can not be held liable for failure to execute the concluded contract, due to the occurrence of an event of force majeure and in particular in the case of total or partial strike by postal services, transport agencies, or catastrophes caused by floods or fires. Concerning products bought to satisfy professional needs, Planète Air sarl - France Trampoline will incur no liability for any indirect damages due to the present conditions, loss of service, loss of profit, damages or fees which may occur. The choice and purchase of a product are placed under the sole responsibility of the client. The total or partial impossibility of using the products, particularly due to incompatibility of material can lead in no instance to any damages, reimbursements or the incurring of any liability by Planète Air sarl - France Trampoline, except in the case of confirmed hidden damages, of non-conformity, defect or the exercise of the right of cancellation.
11 - Intellectual Property

No one is authorized to reproduce, exploit, redistribute or use for any reason, even partially, the elements of the site, whether software, visual or audio material.
In accordance with the law pertaining to computing, to files and to liberties of the 6th of January, 1978, information that identifies buyer may be the object of automated treatment. The information transmitted by the client is for the exclusive use of Planète Air sarl - France Trampoline. 13 - Storage
